Public Law 110–314. Specifically, the

3 t' A4 T1 K: Y7 h: prequirements of paragraphs 14(a)(1), (2),
" F0 u7 f' ]3 A) x# n" E6 nand (3) that otherwise require testing7 u" a! q% F: ?( H: S
and issuance of certificates of
( D/ z7 U2 G. a* ^( Ecompliance by manufacturers, including' t4 r2 a6 o9 _' G
importers, of products subject to an
. x& b+ s" [& eapplicable consumer product safety rule
6 e% [; [9 k$ r& \) y3 n, Cas defined in the CPSA or similar rule,
4 f, g7 t2 {0 d& S- E; \ban, standard, or regulation under any; _# |' `3 g- A# {2 h% S7 G" Y, b
other Act enforced by the Commission.
& X- C8 v% R% Y, `- e! ]" N. iThis stay covers all such requirements
6 ?( s2 x: Y) e3 M, ?with the exception of:3 c8 C2 M* L3 a8 o; d4 y
(1) Those where testing and
U! D$ ^% u8 x) t6 Fcertification was required by subsection
/ S) S* H X( d3 J6 z3 u14(a) of the CPSA prior to enactment of* u- C+ `. x6 |% p" i) }6 j
the CPSIA; and/ F. r2 s, }' u/ g
(2) Those requirements, when they- s9 c0 p; r$ t% D
become effective, applicable to. M" u. p$ s% ]2 E$ h4 h' F% q
children’s product certifications! h, M h# d8 t8 h. g# G6 J( }& O
required to be supported by third party& r1 ?+ ?9 q0 G
testing for which the Commission has1 C! X; R' b- k9 D% V
issued requirements for acceptance of' I3 H) E" ]7 h+ \. ^5 Y
accreditation of third party testing# o* y6 E, ?% f; Q! e1 C1 Q
laboratories to test for: U4 ?7 W( p5 x
• Lead paint (effective for products
# A( _1 a! m5 {6 b# D4 }manufactured after December 21, 2008),
F, }9 p4 g0 E- k0 b• Full-size and non-full size cribs and
3 T& [' f/ o2 P" v6 Tpacifiers (effective for products
/ w2 \& b+ ]' X; O! a9 F* F$ Tmanufactured after January 20, 2009),8 P& {0 ?( h, j0 ~ e" ]4 W
• Small parts (effective for products6 F" {# [0 E: a4 U, j% Y" x
manufactured after February 15, 2009),

, U# ?5 B% Y. w# d. ^6 U$ n% lmetal jewelry (effective for products
' {8 V3 j0 J) {/ c, X9 omanufactured after March 23, 2009);

expressly required by CPSC regulations;

(4) The certifications required due to. {" `/ d Z. A I, O6 |) ^2 N
certain requirements of the Virginia. i* N$ h) @) j4 g. b+ h
Graeme Baker Pool & Spa Safety Act
7 M l; N5 }7 Y3 ebeing defined as consumer product. f: ^( i3 k7 _4 I" f
safety ‘‘rules;’’ and- t6 U# K7 K7 e: o% a; N2 l# S. a
(5) The certifications of compliance8 j: `* z$ F" Q0 I
required for ATVs in section 42(a)(2) of
0 x$ a) v) J8 O+ Ethe CPSA which were added by CPSIA;+ S0 S/ m! {4 r+ @& d- N( S
and
7 L( ^% S* ~ W5 J {(6) Any voluntary guarantees# M$ o" [" [. ]
provided for in the Flammable Fabrics4 m# e1 N6 }3 M; a% F0 \
Act (‘‘FFA’’) or otherwise (to the extent
2 n2 R+ X, w! D% [: O& z. E! Ca guarantor wishes to issue one)./ M! ?% ]* {3 v- S
This stay will remain in effect until; B6 b; A$ h) E& q. ^
February 10, 2010, at which time the
" b5 D* }- Y$ \- _. y6 u$ PCommission will vote to terminate the& x* K: R0 S0 p0 |" q1 {' Y. y; M
stay. This stay does not alter or+ D( G# p; ~) H+ z
postpone the requirement that all
% C/ X- A1 H! P+ E9 Pproducts meet applicable consumer! O* X7 u# H0 j- N( j R- v
product safety rules as defined in the" U2 R" ?6 n. m' W. ]
CPSA or similar rules, bans, standards,
I1 v! q7 i T2 G5 yor regulations under any other Act# k/ P* e3 R" k; ?" T$ u

DATES: Effective Date: This stay is
