The Consumer Product Safety Improvement Act of 2008 was legislated on 14 August 2008 that+ [5 `1 J$ a# _# n$ }: x
regulates the manufacturing and testing of imported consumer goods in the US.
9 l G4 g$ S5 `5 NThe new Consumer Product Safety Improvement Act, due to be in force by stages, requires$ n( P ]7 ?. o* P( C4 L. o
mandatory third-party testing of products intended for children aged 12 and under covering a. _4 i# O. p5 z' J' I& E4 s: A
broad spectrum of product categories, including toys, furniture, baby cribs, pacifiers, children’s
( |2 [5 R4 n: c. v4 d4 K) S4 Jmetal jewellery, baby carriers, high chairs, strollers, walkers, swings and cradles.
* r1 {: }1 E. L' I0 b; Q8 kThe Act will ban the sale of consumer products that contain excessive amount of following3 o! `9 i1 d/ Y4 {
substances by the respective effective dates:
# P2 \1 U) ~ L- Total lead content by weight for any accessible part of children’s product through
2 ^4 q* s Z6 Y" M8 x2 q1 Yreasonably foreseeable use and abuse e.g. swallowing, mouthing, breaking, or other
# W% K- Y7 F. ~6 q, dchildren’s activities, and the aging of the product:# j, d$ g9 f- k: b! t
o more than 600ppm (beginning 10 February 2009);
9 d0 |4 f# F o; e) ko more than 300ppm (beginning 14 August 2009);" D# @5 @: B" r& V6 d3 W
o more than 100ppm (beginning 14 August 2011);* m! h8 u8 N$ ^; P" i$ G! m. J1 Y
- Lead in paint and surface coating in max concentration of 0.009% or, more than 2μg1 c; I. V# N; N; g& s9 X6 Q% _' k$ `
of lead in a total weight ≤ 10mg of paint or other surface coating or in a surface area ≤" h0 T# B& n7 f0 P; X4 U
1cm2 (beginning 14 August 2009);
: c7 c. D8 e4 d k' E q- Phthalates (DEHP, DBP or BBP) in concentrations exceeding 0.1% by weight of
# f5 Z( h2 i! b( F# ^3 Kchildren’s toy or childcare article, or phthalates (DINP, DIDP or DnOP) in0 h5 I, l( G' g! m" ]. X: W
concentrations exceeding 0.1% by weight of children’s toy that can be placed in a
+ @% o2 j$ O" Z1 _$ uchild’s mouth or childcare article (beginning 10 February 2009).
% z: H: D. q/ G. H5 e+ \5 AThe Act also specifies ASTM F963-07 Consumer Safety Specifications for Toy Safety as& I& ]6 a o+ M" h
mandatory standard under the Consumer Product Safety Act and demands rulemaking process for o- K% |% Y" H. B9 W$ C
12 specified durable nursery products for use by children under the age of five years.
+ Q& [6 a( E$ B# sThe Act further requires that children’s product and its packaging should come with a tracking
, T/ ^* W7 U" c% Wlabel that allows officials to trace a product back to its factory in the event of a recall. Any
P$ }; V& C. n% Fadvertisement for direct marketing shall carry appropriate cautionary statement for product that
